Talc Lawsuit Signed Retainer Cases

How many of us didn’t grow up with talcum powder? It was always in the bathroom, either on the counter, in a drawer or in a closet. Everyone used it at some point. Some got a daily sprinkle of it. Some of us had our diapers frosted by it daily. It was one of those household items that were part of our lives, like toothpaste, cereal or television. The sad fact is there was more than just talcum powder in those handy containers. Asbestos, a mineral that’s known to cause cancer, may have also been floating through the air or pressed up against our bodies along with the talcum powder.

Talcum powder trials have resulted in some mammoth jury verdicts. What seemed to be a far-fetched, ‘Hail Mary’ kind of litigation has gotten traction.

If your firm is involved in talc litigation, ZeroRisk Cases® can provide you high-quality legal leads and connect you with the clients you need. Our team has a division focused solely on mass tort lead generation for talcum powder lawyers and law firms.

What is talc? Why is talcum powder a problem?

Talc is a common silicate mineral that is different from nearly all other minerals because of its extreme softness. It has a soapy or greasy feel which lead to the name soapstone, which is a mix of talc and other minerals.

Most talc in the US is produced from open pit mining where the rock is drilled, blasted, and partially crushed in the mining operation. Operations try to avoid contaminating the talc with other types of rock, which can introduce hard particles that cause problems when talc is being used because of its softness. Partially crushed rock is taken from the mine to a mill, where it is further reduced in particle size.

Asbestos is also a mineral found underground. Its use has been heavily regulated in the US, though its use is still allowed in minute quantities. In the 1970’s limits were placed on its use because with enough exposure there’s a good chance asbestos could cause a number of cancers, including mesothelioma, lung and colon cancer.

Veins of asbestos can often be found in talc deposits, leading to a risk of cross-contamination. The potential danger of developing cancer due to use of talcum powder products isn’t the talc, it’s the asbestos that may accidentally be mixed in with it.

Our firm is dedicated to bringing justice to the individuals and families who have been affected by the harsh chemicals in talcum powder. Our mass tort lead generation services are designed specifically with talcum powder lawyers and law firms in mind. Our team understands the intricacy of a talc case and can provide you the resources you need to develop a strong case with reliable and vetted plaintiffs.

Missouri talcum powder case results in $4.69 billion verdict against Johnson & Johnson

A St. Louis jury decided Johnson & Johnson (J&J) should pay $4.69 billion in damages to 22 women and their families in 2018. They claimed their ovarian cancer was caused by the company’s baby powder, according to the Wall St. Journal.

The jury awarded $550 million in damages then added $4.14 billion in punitive damages against the company, which was accused of knowing for decades its products were contaminated with asbestos but it failed to warn users that its talcum powder raised the risk of ovarian cancer.

In the six week trial plaintiffs claimed that asbestos fibers contaminating the talc used to make the company’s Baby Powder entered the plaintiffs’ bodies. The women stated they used the product every day for decades for feminine hygiene. Six of the plaintiffs were estates of those who were killed by the disease. The company denies its products contain asbestos, are dangerous or cause cancer.

Plaintiffs in talcum powder cases allege it caused cancer in their ovaries after the powder particles (applied to the genital area or on sanitary napkins, diaphragms, or condoms) traveled through the vagina, uterus, and fallopian tubes to the ovary.

Many studies in women have considered whether there’s a link between talcum powder and ovarian cancer, reports the American Cancer Society. Findings are described as mixed, with some finding a slightly increased risk while others state there’s no increase. There are case-control studies finding a small increase in risk of cancer due to the powder.

At the time the company faced more than 9,000 talc-related cases. That figure has increased to about 15,500. J&J has had some successes at trial and in appeals overturning verdicts.

  • In 2017 a California woman was awarded $417 million in her case against J&J but the judge overturned the verdict.
  • In a California lawsuit the jury awarded a woman $25.75 million after finding J&J liable for her mesothelioma.

J&J’s supplier of talc declared bankruptcy in early 2019, claiming it didn’t have the resources to defend itself in the thousands of pending talcum powder cases.
